Colorado, unlike Virginia, does not have a crime of "
abduction with intent to defile", which is simply called "kidnapping" out here in the American West. Perhaps in Virginia, there are other purposes for which you may lawfully abduct someone. Is a suspect arrested on that charge eligible for release if it turns out that robbery was his motive instead?
