Anonymous Blogger Wins Suit.

The Delaware Supreme Court has held that an ISP does not have to disclose the identity of an anonymous blogger engaged in political speech on the internet. A would be defamation plaintiff must attempt to notify the anonymous speaker of the effort to disclose his or her identity, and must make a prima facie case that could withstand a motion for summary judgment, before the disclosure is permitted.

It is the first ruling of its kind on the issue in the nation and gives new life to the 1st Amendment right to speak anonymously.
